Degrees of Crimes

Degree & Classes of Offenses

Offense: According to N.J.S.A. 2C:1-4, an offense is when the sentence of imprisonment is in excess of six (6) months.

Crimes are designated as being First, Second, Third or Fourth Degree.

Disorderly Persons Offense: According to NJSA 2C:1-4(b), a petty disorderly persons offense and disorderly persons offense are not crimes. Basically, this means there is no right of indictment by a grand jury or right to jury trial.

According to N.J.S.A. 2C:1-4c an offense may be classified as a misdemeanor when such offense provides for a maximum penalty of 6 months imprisonment or less, wither or not combined with a fine.
