A conviction of 3rd degree aggravated assault requires proof that the defendant attempted to cause or purposely or knowingly caused bodily injury to another with a deadly weapon. A third-degree aggravated assault charge may also be proven by showing that a person caused bodily injury to another person while fleeing or attempting to elude law-enforcement officer in violation of N.J.S.A. 2C:29-2 or while operating a motor vehicle in violation of N.J.S.A. 2C: 20–10
A 2nd degree aggravated assault charge pursuant to N.J.S. 2C:12–1(b)(1) occurs when one attempts to cause serious bodily injury to another or causes such injury purposely, knowingly, or under circumstances manifesting extreme indifference to the value of human life, recklessly causing such injury.
