What Is Age Discrimination Under New Jersey Law?

Age discrimination occurs when an employer takes an adverse employment action against an employee because of their age. It is illegal under both federal and New Jersey law, and it affects every aspect of employment — hiring, promotions, wages, termination, layoffs, and the terms and conditions of daily work.

Two laws protect New Jersey employees from age discrimination, and they differ in important ways. The federal Age Discrimination in Employment Act of 1967 (ADEA) prohibits discrimination against workers 40 and older, but only applies to employers with at least 20 employees. The New Jersey Law Against Discrimination (NJLAD) is broader on both counts: it protects employees between the ages of 18 and 70, and it applies to all New Jersey employers regardless of size. For most employees, this means the NJLAD provides the stronger and more accessible protection.

Age discrimination does not always take the form of an outright firing. It includes being passed over for promotion in favor of younger, less qualified candidates, receiving comments about needing "fresh blood" or a "new direction," being excluded from training or advancement opportunities, and being targeted in a reduction in force while younger employees with similar qualifications are retained. Harassment based on age is also illegal when it is severe or persistent enough to create a hostile work environment or results in an adverse employment action.

Age Discrimination in Employment Act of 1967 (ADEA)

Protects workers 40 and older from age discrimination. Applies to employers with 20 or more employees, employment agencies, and labor organizations. Also prohibits age-based preferences or limitations in job postings, denial of benefits to older employees, and mandatory retirement requirements in most circumstances.

New Jersey Law Against Discrimination (NJLAD)

Protects employees between the ages of 18 and 70 from age discrimination. Applies to all New Jersey employers regardless of size. Also bars retaliation against employees who make age discrimination complaints and prohibits age-based criteria in the hiring or recruitment process unless age is a bona fide occupational qualification for the job.

Who Is Protected Under This Law?

The NJLAD protects New Jersey employees between the ages of 18 and 70 from age-based discrimination. The federal ADEA protects workers 40 and older whose employers have at least 20 employees. Because the NJLAD covers all employers and a broader age range, it is the primary protection for most New Jersey workers — including those under 40 and those working for smaller employers not covered by the ADEA.

What You Need to Prove in an Age Discrimination Case

To bring a successful age discrimination claim, you generally need to establish the following, but you do not need to have all of this figured out before you call.

Under the NJLAD, you must be between 18 and 70. Under the ADEA, you must be 40 or older. Your employer must also be covered by the applicable law.
